These terms and conditions shall govern the relationship between Globus Bank Limited (“the
Bank”) and a person or legal entity (“Customer“ or “You” or “I/we” or “me/our”) who has accepted
to be bound by same.
I/We hereby authorise you to open an account in my/our name and authorise all cheques or
other orders/instructions which may be presented with respect to the account provided
that same is issued in accordance with my/our mandate and there are sufficient funds in
the account.
I/We hereby agree that we shall provide all information and document required by the
Bank from time to time in relation to my/our account.
I/We hereby agree that I/We shall bear full liability and/or consequence with respect to
the issuance of any cheque, orders, bills, notes, negotiable instruments
issued/deposited with respect to my/our account.
I/We hereby agree that where there is any disagreement between us or
within the officers of my/our company, the Bank may in its discretion freeze or restrict
activities on the account pending the resolution of the disagreement.
I/We hereby agree that any request made to the Bank by way of any
application for a credit facility(ies) shall be signed by our authorized signatories.
I/We hereby agree that in consideration of the Bank giving me/us financial
and/banking accommodation and other facilities, the Bank shall in addition to any right
of set-off or similar rights prescribed by law be entitled without notice to combine and
consolidate all or any of my/our account with any financial institution in Nigeria
and/or to set off any amount owed by me/us or either of us to the bank against account
whether held on the current or deposit account or otherwise whether in Naira or any
other currency in such institution.
I/We hereby agree that the bank shall bear no liability for any funds
handed to a staff of the Bank outside the Bank’s premises or outside banking hours.
I/We hereby agree that the Bank shall not be liable for any loss of funds
deposited with it due to any act or order beyond its control.
I/We hereby agree that the Bank is fully indemnified against any liability
that may arise from the operation or non-operation or negligence of my/our operation of
the account.
I/We authorise the Bank to debit our account with the applicable charges
for legal search conducted on our account at the Corporate Affairs Commission or the
relevant agency/authority.
I/We agree that where any provision of these terms and conditions is found
to be unenforceable or invalid under any applicable law, such unenforceability or
invalidity shall not render the whole document invalid but same shall be deleted without
affecting the remaining provisions.
I/We hereby authorise and grant consent to the Bank to carry out the
necessary checks on me/us at the various credit bureaus and reference agencies and also
share with such agencies our information. The Bank is discharged from any form of
liability or damages made against it by virtue of granting this consent.
I/We hereby state that by the provision of any information by me/us to the
Bank, the Bank is authorised to access any and all my/our information.
I/We hereby indemnify the Bank at all times against any claim, suit,
garnishee/mareva, costs, damages, legal fees which may be brought or incurred by the
Bank in relation to my/our account.
I/We hereby agree that speed or lack of interruption of the Web or Mobile
banking services is not guaranteed at all times. I/we also agree that the service may be
interrupted due to maintenance services or those of third-party agents who provide part
of the service. In addition, the service may be affected by the coverage available from
my/our mobile network provider and/or maintenance and upgrades they perform.
I/We hereby state that all information provided by me/us to the Bank is
true, complete and accurate.
I/We hereby agree that I/we shall be solely responsible for the safekeeping
and confidentiality of Personal Identification Number (PIN), user id, passwords,
passcodes, statement of account, ATM card/details, cheque books, internet banking
password/pin, tokens etc. and the Bank shall not be responsible at any time for any
unauthorized access or liability.
I/We hereby agree that the bank shall not be liable for any electronic
virus or viruses that I/we may encounter in the course of usage of this service.
I/We hereby agree that the bank shall not be liable for any network
related issues.
I/We hereby agree that we shall not issue any cheque or instrument without
ensuring that our account is funded to accommodate such payment and I/we hereby
authorize the Bank to enforce/report same to the regulatory/law enforcement authorities.
I/We hereby agree that the bank may close our account(s), where there is a
suspicious inflow into our account, in compliance with a regulatory order or where there
is any fraud in relation thereto.
I/We agree that we shall not issue cheque in favour of any staff of the
Bank, or transfer money into his/her account and in the event of such, the bank is fully
indemnified against all loss, claim, action, damages, request which may arise therefrom.
I/We agree that the Bank may debit my/our account with banking charges,
interests and fees as may be determined from time to time and I/we hereby exonerate the
Bank from liability for taking such charges without prior notification.
I/We hereby indemnify the Bank against any loss, damages, claim that may be
occasioned on the account by reason of any falsehood or inaccuracy of any statement or
information or misrepresentation made to the Bank.
I/We hereby agree that the service is provided by the Bank on “as is” and
“as available” basis and the Bank shall not be liable for any warranty of any kind,
whether express or implied.
I/We agree that this terms and conditions may change from time to time and
I/we agree to be legally bound by the provisions of same and waive any rights to be
formally notified.
I/We hereby agree that the Bank reserves the right to close this account
and to end this agreement if the operation of this account is not been satisfactory or
where I/we have contravened any of these terms and conditions.
I/We hereby agree that any changes in my/our name, telephone number,
marital status, residential or office address or loss or compromise of information etc.
will be communicated to the Bank as quick as possible.
I/We agree that the intellectual property in the service shall continue to
remain the property of the Bank and the Bank is entitled to terminate the service where
same is used for any illegal or unacceptable purpose.
I/We hereby agree that under no circumstances shall the Bank be liable for
any indirect, consequential, special or exemplary damages arising out of or in
connection with my/our access or use of the services.
I/We hereby agree that the we may request closure of the account subject
to not having any outstanding obligation to the Bank. I/we also agree that the Bank may
close the account without giving any reason within three (3) days’ notice to me/us or
immediately upon issuing a notice to me/us and all existing obligations has been sorted
by me/us.
I/We agree that this Terms and Conditions is governed by the laws of the
Federal Republic of Nigeria and the courts of Nigeria may deal with any claim, dispute
or difference arising therefrom.
The Nigeria Data Protection Regulation (NDPR) was introduced with the
objective of safe guarding the rights of natural persons to data privacy, preventing
manipulation of personal data and ensure safe conduct of transactions involving exchange
of personal data. Globus Bank will ensure that same is complied with.
We hereby state that we are the “data controller” and “data processor”, of your personal
data and we shall only obtain and utilize same with your consent. We also state that
your personal data will only be utilized for the purpose of providing banking services
to you.
We shall also ensure that all your personal data is adequately secured and kept
confidential for as long as required by the regulatory authorities and/or except as
required by the relevant regulatory or legal authorities.
